The present bail application has been filed by the applicant in Case Crime No.2317 of 2016, S.S.T. No. 91 of 2017, u/s 302 IPC, P.S. Bisalpur, District Pilibhit with the prayer for enlarging him on bail.
Having heard learned counsel for the applicant, learned AGA for the State and considering the fact that it is a case of honour killing in which the applicant has falsely implicated some other persons with the allegation that they had abducted his sister (deceased) and then after raping murdered her; during investigation, statements of some independent witnesses were recorded in which they have stated that the applicant's sister was having an affair with one Pradeep Kumar and she used to meet him in dead hour of the night; on the date of incident she had also gone to meet him, therefore, the applicant in order to save honour of the family had murdered by firing on his sister after dragging near a Paakar tree; the post mortem report also supports version of firing; so far as the allegation of rape as alleged by the applicant in the F.I.R. is concerned, in the post mortem report, I do not find any injury on the genitals of the victim. Considering the overall facts and circumstances of the case, I do not find it to be a fit case for enlarging the applicant on bail.
The bail application is, accordingly, rejected.
However, the trial court is directed to expedite the trial and conclude the same preferably within the period of six months from the date of production of the certified copy of this order before the trial court.
