Heard Sri Arvind Kumar Srivastava, learned counsel for the petitioner and learned Standing Counsel for the State respondents.
Sri Arvind Kumar Srivastava, learned counsel for the petitioner submits that the petitioner undertakes to cooperate with the enquiry officer and submit his defence before the enquiry officer in regard to the chargesheet drawn up against him. The petitioner shall appear before the enquiry officer on 12.02.2019.
The chargesheet along with the documents proposed to be relied upon against the petitioner shall be supplied to the petitioner on 12.06.2019 by the enquiry officer. The enquiry officer shall record an endorsement in the enquiry proceedings regarding receipt of chargesheet and the documents in support of the charge by the petitioner on 12.06.2019 or on any other date fixed by the enquiry officer. In case for some reason, the enquiry proceedings cannot happen on 12.06.2019, the enquiry officer shall fix another date in the presence of the petitioner. The petitioner shall sign the record of the enquiry proceedings to attest his presence before the enquiry officer. Thereafter the enquiry officer shall proceed and conclude the enquiry within a period of six months. In case, the petitioner does not cooperate with the enquiry proceedings, the enquiry officer proceed ex- parte to the petitioner and pass appropriate orders in accordance with law.
With the aforesaid directions, the writ petition is disposed of finally.
