This petition has been filed challenging the order dated 08.07.2016 passed by the opposite party no.1 rejecting the Recall Application of the petitioner praying for Recall of the Award dated 03.08.2015.
The Award dated 03.08.2015 has not been challenged in the petition.
Today, none appears for the petitioner. Shri Shiv Kumar, who appears for the contesting-respondents has pointed out the orders dated 04.02.2019 and 20.02.2019 passed by this Court which are being quoted hereinbelow:-
Order dated 04.02.2019 "?On the joint request of learned counsel for the contesting parties, list this case the next week.
Sri Shiv Kumar, learned counsel for the claimant respondent has raised a preliminary objection pertaining to the maintainability of the present petition. It is expected that learned counsel for the petitioner shall address the question on the maintainability of the petition on the next date.
Order dated 20.02.2019 ?1. Sri Anand Kumar Arya, Advocate holding brief on behalf of Sri Alok Kumar Srivastava, learned counsel for the petitioner says that the matter be listed in the next cause list as his Senior is out of station.
2. The counsel for the respondents has pointed out the order passed by this Court on 04.02.2019, the counsel for the petitioner had to address this Court regarding the maintainability of the petition.
3. In case no argument regarding maintainability of the petition is made on the next date the Writ Petition shall stands dismissed as not maintainable.
4. List this matter on 15.03.2019."
The writ petition has been filed only against the rejection of Recall application, hence, it is dismissed as not maintainable. Consequences to follow.
