After the suit for specific performance filed by the petitioner was decreed on 26.5.2007, he put the decree into execution and eversince then the case remained pending.
It has been stated by the petitioner through a Supplementary Affidavit that the Court dealing with the application is vacant since a very long time. The supplementary affidavit be taken on record.
Under such circumstances, the petitioner may move an application before the District Judge for the transfer of the case to a Court which is not vacant and upon the transfer, the case shall be taken up on a day to day basis. Adjournment may be granted under very pressing circumstances and that too on the imposition of a minimum cost of Rs.2000/- on the party seeking adjournment.
The writ petition is, accordingly, disposed of.
