Heard learned counsel for the parties.
By the instant writ petition, petitioners seek the following relief:
"A. Issue a writ, order or direction in the nature of mandamus directing the respondents, Sub Divisional Officer, Tehsil- Narwal, District-Kanpur Nagar to decide, case No. 8/1/11-12 of the year 2009 under section 198(4) Z.A. & L.R. Village-Nagwa Pargana, District- Kanpur Nagar in respect of the Araji NO. 216 area 5 Bigha by giving the benefit of provision under Section 122(B)(4F) Z.A. & L.R. Act in pursuance of the order dated 29.4.2005 passed in revision No. 9/86/2004-05 passed by the Commissioner Kanpur Region Kanpur as well as order dated 31.8.2009 passed in case No. 58/07-08 passed by Additional District Magistrate (F&R) Kanpur Nagar within stipulated period. And/or to pass such other or further order which this Hon'ble court may deem fit and proper under the circumstances of the case."
Learned counsel appearing for the State respondents submits that 4th respondent- Sub Divisional Magistrate shall decide the pending case expeditiously.
In view thereof, on consent of the learned counsel for the parties, the writ petition is being finally disposed of directing the 4th respondent- Sub Divisional Magistrate, Pargana and Tehsil- Narwal, District- Kanpur Nagar to decide Case No. 8/1/11-12 of the year 2009 under section 198(4) Z.A. & L.R. Act, expeditiously, preferably within two months from the date of filing of copy of this order/after affording opportunity of hearing to all the aggrieved parties.
