JUDGMENT / ORDER

Hon'ble Ravi Nath Tilhari,J.
From the written instruction provided to the counsel for the respondent Bank it appears that the respondent Bank has not released payment on the ground that there is a pending civil dispute between the parties.
It has not been disclosed whether in the pending civil dispute any injunction order has been passed or not. In case the Bank has issued certificate on either or survivor basis, on death of one of the holders, the other survivor of the deposit may automatically get a right to the deposit and, therefore, the Bank shall file an affidavit disclosing whether the deposits were on either or survivor basis. If so, whether there has been a release in favour of the survivor. If not, whether there is any injunction operating against the Bank or the survivor from seeking release of the deposit amount.
Affidavit as above be filed within two weeks.
