Heard Sri Akshay Mohiley, learned counsel for the petitioner, learned Standing Counsel for the State-respondent no.1 and Sri Wasim Masood, learned counsel for the respondent nos.2 and 3.
By means of this writ petition, the petitioner has come up before this Court with the prayer to quash the impugned recovery citation dated 16.04.2019 issued against the petitioner. It has further been prayed that respondent no.2 may be directed to pass suitable orders on the interim relief application filed by the petitioner.
In the complaint filed by the respondent no.4, the respondent no.2 passed an order dated 25.06.2018 directing the petitioner herein to refund the complete amount with interest. Against the order dated 25.06.2018, the petitioner preferred an appeal under Section 44 (1) of the Real Estate (Regulation and Development) Act, 2016 on 14.05.2019 after considerable delay. The delay condonation application is still pending for consideration.
It is expected that the Real Estate Regulatory Tribunal may act in accordance with law after giving notice to all the respondents.
In view of the above, we are not inclined to interfere in the matter at this stage.
The writ petition is, accordingly, dismissed.
