(Per : HONOURABLE MR.JUSTICE AKIL KURESHI) This contempt petition arises out of suo motu cognizance taken by the Division Bench and in the following factual back ground.
The opponent, Dr. Brijendra Prasad, had filed Special Civil Application No. 3408 of 2011 before this Court challenging the judgement of the Administrative Tribunal, Ahmedabad dated 02.12.2010 in Original Application No. 427 of 2010. The Tribunal rejected such original application filed by the present opponent.
The Division Bench of this Court, by an order dated 05.12.2011 passed in Special Civil Application No. 3400 of 2011 while dismissing the petition, imposed costs of Rs. 5,000/- to be paid by the opponent to the Gujarat State Legal Services Authority within fifteen days.
Since such cost was not paid, the Bench, in the order dated 20.01.2012, recorded prima facie opinion that the opponent has committed contempt, and therefore, such proceedings are required to be initiated against him. Pursuant to such order, the Registry placed the matter before us.
