(Per : HONOURABLE THE ACTING CHIEF JUSTICE MR.BHASKAR BHATTACHARYA) Pursuant to our earlier order dated May 03, 2012, further affidavit has been affirmed by Mr.N.N. Patel, Assistant Director, Industrial Safety and Health, Mehsana, on behalf of respondent No.1. We have gone through the said affidavit. It appears that after inspection of factory of respondent No.3, the said respondent is fully satisfied that the respondent No.3 has complied with our directions contained in our main order dated November 30, 2011.
In view of such fact, we find that there is no necessity of unnecessarily keeping respondent No.3 as a party to this proceeding and accordingly, we dispose of this application so far respondent No.3 is concerned. Formal notice is discharged against the respondent No.3. We, however, keep the matter pending so far as other added respondents are concerned.
We, therefore, propose to hear the matter further on next Thursday as regards other added respondents pursuant to the direction given by this Court. Let the matter appear on July 05, 2012.
Further affidavit filed on behalf of Maruti Chemicals be kept with the record. The parties are at liberty to file their reply, if they so desire.
