(Per : HONOURABLE THE ACTING CHIEF JUSTICE MR.BHASKAR BHATTACHARYA) After going through the further affidavit filed by the respondent No.3 in compliance of the direction given by us vide our order dated November 30, 2011, we find that the respondent No.3 has claimed to have complied fully our direction and consequently has requested the Director, National Institute of Occupational Health (NIOH) to inspect the system. Such letter has been written on April 20, 2012 and we are told by Mr Kavina appearing on behalf of the respondent No.3 that till date the same has not been inspected. We, therefore, place the matter on June 21, 2012 for further orders awaiting the report of inspection. We also direct the Factory Inspector of the State of Gujarat to visit the factory of the respondent No.3 and to give report whether our earlier order has been complied with.
So far as the other newly added respondents are concerned, after going through their affidavits, we find that they are yet to comply with the direction given by us and thus we direct them to give further affidavit disclosing full compliance of our order by the next date fixed, namely, June 21, 2012.
Mr Oza's client i.e. respondent No.5 is directed to serve a copy of the affidavit upon the added respondents so that they can deal with those allegations. The added respondents will further answer to the report of the amicus curiae which is annexed at page 464 of this writ-application by the next date.
The office is directed to comply with our direction dated April 26, 2012 by which we directed that the names of the learned counsel appearing on behalf of the newly added respondents be shown on the Board.
Let the matter appear on June 21, 2012.
