Learned counsel for the petitioner is permitted to correct the prayer of the memo of writ petition.
Heard learned counsel for the petitioner and the learned A.G.A. for the State of U.P.
Only prayer made by the learned counsel for the petitioner in this writ petition is that the respondent no.2 be directed to consider and decide the representations dated 30.5.2014, 16.7.2014, 17.7.2014 and 28.8.2014 moved by the petitioner before him, copies whereof have been brought on record as Annexure Nos. 11, 12, 13 and 14 to the writ petition with a prayer to transfer the investigation of case crime no.83 of 2013, under section 364 I.P.C. & section 3(2)5 SC/ST Act, Police Station Ughaiti, District Budaun from Civil Police to Central Bureau of Investigation.
Learned A.G.A. has no objection to the aforesaid prayer made by the learned counsel for the petitioner .
After having heard learned counsel for the parties and perused the material brought on record, without going into the merits of the case, this writ petition is finally disposed of with a direction to the respondent no.2 that in case the petitioner moves a fresh representation before him within two weeks from today alongwith certified copy of this order with a prayer to transfer the investigation of case crime no.83 of 2013, under section 364 I.P.C. & section 3(2)5 SC/ST Act, Police Station Ughaiti, District Budaun to Central Bureau of Investigation, he shall pass appropriate order on the said representation within a further period of six seeks.
