Heard counsel for the plaintiff-petitioners.
The petitioners have preferred the present petition inter-alia with the prayer to direct the court below namely Additional Civil Judge (Junior Division) Ist, Jaunpur to decide the Original Suit No. 1290 of 1993 (Sunti Devi and another vs. Hari Mohan), within stipulated period.
On 21.01.2021 the following order was passed:-
"Bearing in mind the fact that the suit which has been instituted in 1993 remains pending in the Court of the Munsif, Jaunpur, the Court requests the Registrar General of this Court to obtain a report from the concerned Presiding Officer.
Include in the list of fresh cases of 17 February 2021 before the appropriate Court.
This case shall not be treated as tied up or part heard to this Court. "
Pursuant to the same, a report has been submitted by the Additional Civil Judge (Junior Division) Ist Jaunpur on 03.02.2021 stating therein that due to various reasons the case could not be decided. It is further stated that she will trying to decide the entire suit most expeditiously and preferably within a period of six months.
Heard counsel for the petitioners and perused the record.
Without entering into the merits of the issue, the present petition stands disposed of finally with a direction to the court below namely Additional Civil Judge (Junior Division), Ist, Jaunpur to consider and decide the aforesaid suit in accordance with law most expeditiously and preferably within a period of six months from the date of production of self attested computer generated copy of this order downloaded from the official website of High Court Allahabad but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties, if there is no legal impediment.
