JUDGMENT / ORDER

The petitioner is aggrieved with his transfer. The petitioner's allegation is that the same is vitiated by malafides. If that is so, under Section 69(2) (d), definitely the petitioner has to approach the Arbitration Court for redressal. The petitioner also has filed a representation before the Registrar, which however, cannot be considered for reason of lack of jurisdiction. However, if the petitioner files a representation before the Managing Committee, within two days from today, the committee shall consider the same and pass orders within a week thereafter. The petitioner shall not be disturbed till then, since the petitioner was allowed to continue during the pendency of the writ petition. However, if the committees decision goes against the petitioner, the petitioner will have to necessarily concede to the transfer, subject to any further proceedings taken under Section 69(2)(d). Writ petition disposed of.
