Heard learned counsel for the petitioners and the learned A.G.A.
This writ petition has been filed praying for the following reliefs:
"(i) Issue a writ order or direction in the nature of certiorari quashing the impugned First Information Report dated 13.8.2021 (Annexure No. 1 to the writ petition) registered as Case Crime No. 525 of 2021 under Section 3(1) of U.P. Gangster and Anti-Social Activities (Prevention) Act, 1986, P.S. Cantt., District Gorakhpur.
(ii) Issue a writ, order or direction in the nature of mandamus commanding the police authorities not to arrest and not to harass the petitioners in pursuance of the impugned first information report."
After the arguments were heard at some length, learned counsel for the petitioners states that this petition be dismissed as not pressed with liberty to apply for bail.
Learned A.G.A. has no objection to the aforesaid request of the petitioners.
In view of the aforesaid, the writ petition is dismissed as not pressed with liberty to the petitioners to apply for bail as permissible under law and in accordance with law.
It is made clear that we have not expressed any opinion on merits of the case of the petitioners.
The party shall file computer generated copy of such order downloaded from the official website of High Court Allahabad, self attested by the petitioner along with a self attested identity proof of the said person (preferably Aadhar Card) mentioning the mobile number to which the said Aadhar Card is linked.
The concerned Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
