THE HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CMP.No.168 of 2013 ORDER:
This petition is filed to transfer FCOP No.1613/2012 from the file of the Family Court, Ranga Reddy to the Family Court, Vijayawada.
2. Wife filed this application seeking transfer on the ground of convenience. According to her affidavit, her marriage was performed at Vijayawada on 23-05-2011, and after some time, she was subjected to cruelty and she gave a report to police, which was registered by Mahila Police and a criminal case is pending at Vijayawada and she got a small child and she is now living on the mercy of her brother and mother and it is difficult for her to come to Ranga Reddy by covering a distance of 250 Kms and that she has no male assistance and no relatives at Ranga Reddy.
3. Other side has not filed any counter disputing the affidavit averments of the petitioner.
4. Heard both sides.
5. There is no dispute with regard to relationship between the parties. According to the submission of Advocate for petitioner, the respondent husband is attending criminal case at Vijayawada and there may not be any prejudice to respondent, if the case is transferred to Vijayawada.
5. Considering reasons stated in the affidavit and also convenience of the wife, FCOP No.1613/2012 is withdrawn from the file of Family Court, Ranga Reddy and transferred to Family Court, Vijayawada for disposal in accordance with law.
6. Accordingly, Tr.CMP is allowed and miscellaneous petitions, if any, pending in this Tr.CMP shall stand disposed of.
