JUDGMENT / ORDER

The petitioner seeks a direction to the respondent to consider his application for temporary permit under Section 87(1)(c) of the Motor Vehicles Act. The case of the petitioner is that the stage carriage route Cheppukulam SCI Church-Vaikkom was being operated on the strength of a regular permit with stage carriage KL 6/C 9627 which has since been surrendered and the route is now not being served by any operator.
2. I have heard the learned Government Pleader appearing on behalf of respondent.
3. In the facts and circumstances of the case, I dispose of the writ petition with a direction to the respondent to consider the application submitted by the petitioner for grant of temporary permit if there is a vacancy of the stage carriage KL-6/C 9627 in the route in question and, in the absence of any other person having a better or preferential claim, to grant temporary permit for four months duration within a week of production of the certified copy of the judgment.
The writ petition is disposed of.
