The writ petitioner herein seeks a writ of mandamus directing further investigation in Crime No.606/2012 of Maranalloor Police Station, registered under section 302 IPC. Even while seeking such a writ of mandamus for further investigation, he seeks a prayer for a writ of certiorari quashing Ext.P5 final report itself. His grievance is that investigation was not properly and legally made initially by the Police officer.
2. The learned Public Prosecutor submits that further investigation in the crime is now being conducted by the Deputy Superintendent of Police, Nedumangad, and it is in progress. In such a situation, this writ petition can be closed, however without prejudice to the right of the petitioner to seek appropriate relief as regards the supplemental final report to be submitted by the Police.
In the result, this petition is closed, without prejudice to the right of the petitioner to seek appropriate relief at the proper stage, as regards the report of further investigation made by the Police.
