Heard learned counsel for the petitioners and the learned A.G.A. for the State.
This writ petition has been filed seeking quashing the impugned F. I. R. dated 02.11.2019, under Section 3(1) U.P. Gangster Act, Police Station Chakeri, District Kanpur Nagar.
The allegation in the F.I.R. is that petitioner is a gangster and he is involved in criminal activities and earlier an F.I.R. was lodged against him and proceeding of Case Crime No.99 of 2019 was initiated.
Learned counsel for the petitioner submits that in that case petitioner was granted bail by the court on 24.09.2019 and the proceedings of that case is mentioned in the present F.I.R. and no other case is mentioned.
Learned A.G.A. is directed to file counter affidavit within three weeks.
List after three weeks.
Till then the petitioner shall not be arrested in pursuance of the F. I. R. dated 02.11.2019, under Section 3(1) U.P. Gangster Act, Police Station Chakeri, District Kanpur Nagar.
However, it is made clear that this order is confined only in respect of the present F.I.R. and not in respect of any other case.
