JUDGMENT / ORDER

Ramachandra Menon,J
Alleging harassment at the hands of 3rd respondent in connection with some money transaction, the petitioner has approached this Court seeking for immediate intervention.
2. It is stated that petitioner is pursuing business in fish vending, in Munambom Fishing Habour. While so, on 11.05.2014, somebody came in a car and attempted to kidnap the petitioner and manhandled him. It was by the timely interference of the local people, that the petitioner could save his life. On bringing the matter to the notice of police, they compelled the petitioner to execute an 'undertaking' to pay an amount of `1.5 lakhs to one Mr.Manoj, who is stated to be a businessman in Kollam, lest they should proceed against the petitioner. This made the petitioner to approach this Court W.P.(c) No.12398 of 2014 2 alleging harassment by Police.
3. Learned State Attorney submits, on instructions, that version of the petitioner is devoid of merits and bona fides. It is stated that the petitioner is indebted to one Mr.Ramalingam, to an extent of `2 lakhs, and when the said amount was demanded by Mr.Ramalingam, he was threatened by the petitioner, which led to a complaint preferred by Mr.Ramalingam. In the said circumstances, both the parties were called to the police station and after negotiations, the petitioner agreed to discharge his liability, thus arriving at a settlement and it was accordingly, that the undertaking was given, agreeing to pay a sum of Rs.1.5 lakhs on 05.05.2014. There occurred another incident on 11.05.2014, when Mr.Ramalingam was threatened/assaulted again, which led to registration of Crime No.602 of 2014 of Munambom Police Station against the petitioner and his brother, for various offences under the IPC. It is pursuant to filing of the said crime, that the petitioner has sought for interference by this Court alleging harassment.

After hearing both the sides, this Court finds that the version of the petitioner as to the alleged harassment does not W.P.(c) No.12398 of 2014 3 deserve any consideration, especially in the light of the submissions made by learned State Attorney that, investigation is going on and that the police has no intention to harass the petitioner in any manner.
Accordingly, the writ petition is dismissed.
