Heard Sri B.M. Singh, learned counsel for the petitioner, Sri Shyam Sundar, learned Standing Counsel for the State and Sri Krishna Kant Singh, learned counsel for the respondent no.3.
Petitioner has filed this petition seeking a direction to respondent no.2 i.e. Sub-divisional Officer, Baberu, District-Banda to expedite the proceedings in application, under Section 115 and 136 of Uttar Pradesh Revenue Code, 2006, which is pending before the respondent no.2.
It is submitted that respondent no.2 i.e. Sub-divisional Officer, Baberu, District-Banda be directed to decide his pending application, under Section 115 and 136 of Uttar Pradesh Revenue Code, 2006.
This prayer is not opposed by Sri Shyam Sundar, learned Standing Counsel for the State.
In view of such facts, this writ petition can be disposed of with a direction to respondent no.2 i.e. Sub-divisional Officer, Baberu, District-Banda to decide the pending application/case of the petitioner on its own merits, referred to above, if possible, within a period of 90 days from the date of receipt of computer downloaded copy in PDF form of this order strictly in accordance with law.
In above terms, the writ petition is disposed off.
It is made clear that this Court has not expressed any opinion on the merits of the case.
