In pursuance of the order of this Court dated 28.5.2010, Smt. Sewata Misra, respondent no.4 is present before this Court who has been identified by Shri A.K.Mishra, Advocate.
On being questioned by the Court as to whether Smt. Sewata Mishra is agreebale for sending the matter for mediation or not, she replied in negative as such the matter cannot be sent to the Mediation and Conciliation Centre.
Heard learned counsel for the petitioner , learned Additional Government Advocate as well as Shri A.K.Mishra, Advocate for the respondent no.4.
Under challenge in the instant writ petition is the FIR relating to Case Crime No.38 of 2009 under Sections 498-A/323/504/506 I.P.C. and 3/4 of the Dowry Prohibition Act, Police Station Mahila Thana, District Gonda.
We have gone through the contents of the FIR. Since it discloses commission of cognizable offence, as such the same cannot be quashed.
Petition is misconceived and is accordingly dismissed.
However, it is provided that if the petitioner surrenders and moves application for bail, the same shall be considered and disposed of expeditiously, by the courts below.
