The petitioner has granted permission to extract extract ordinary sand. Petitioner submits that he has threatened with prohibition on account of using mechanical device. If the petitioner is carrying the activity of removing ordinary sand based on valid permit merely because that he has deployed mechanical devices for removing the extraction of ordinary sand based on valid permit cannot be interfered with. Therefore, there shall be a direction to the respondents not to interfere with petitioner's mining activity on the ground that the petitioner is using mechanical devices for the purpose of mining activity.
Writ petition is disposed of as above.
