Sunil Kumar Yadav vs State Of U P And Others

High Court Of Judicature at Allahabad|24 September, 2021
|

JUDGMENT / ORDER

Court No. - 29
Case :- WRIT - C No. - 18937 of 2021
Petitioner :- Sunil Kumar Yadav
Respondent :- State Of U.P. And 4 Others
Counsel for Petitioner :- Abhishek Kumar Chaubey
Counsel for Respondent :- C.S.C.
Hon'ble Munishwar Nath Bhandari,Acting Chief Justice Hon'ble Vivek Agarwal,J.
The writ petition has been filed to seek a direction for security of the petitioner and accordingly to provide a gunner.
Learned counsel for the petitioner could not show any document or event which may show threat to the petitioner by the person against whom number of cases are pending for investigation and trial. Petitioner seems to be witness in few cases and thereby necessary security protection has been given while attending the court.
We don't find any material to show a real threat to the petitioner so as to provide security.
A reference of F.I.R., registered by the petitioner in the year 2017, has been given without narrating as to whether any event/incidence took place with the petitioner in a period of four years. We otherwise find that in the State of U.P. to have a gunner has become a state of symbol and, therefore, only this Court had issued directions to the State Government not to extend the security unless the material is produced to show a real treat.
Taking overall facts into consideration, we don't find a case for grant of relief. The writ petition is accordingly dismissed.
