Vakalatnama has been filed today in Court by Sri Vinay Sharma, Advocate on behalf of respondent no. 25 and the same is taken on record.
The petitioners have preferred an application dated 05.04.2018 before the Special Land Acquisition Officer, Muzaffarnagar (respondent no. 3) to refer the dispute for adjudication to the Court of original jurisdiction. The application said to be filed on 05.04.2018 has yet not been considered and decided, hence this petition is preferred.
On asking, it is submitted by learned counsel appearing on behalf of the petitioners that the application came up before the Special Land Acquisition Officer on 13.04.2018 but the same was adjourned. Learned counsel is not acquaint as to what happened in the matter on 13.04.2018.
As already stated the application was preferred on 05.04.2018 and the same was listed on 13.04.2018 and counsel for the petitioners is not acquaint as to what happened on 13.04.2018, we are not inclined to interfere in the matter. There is no material to substantiate that any delay is caused in the matter on the count of Special Land Acquisition Officer. It is also pertinent to notice that the Land Acquisition Officer is proceeding in the matter as per sub-Section (3) of Section 20 H of the Railways Act, 1989. Prima-facie, we do not find any wrong with the proceedings initiated that may warrant interference in any manner.
The writ petition, for the reasons given above, is dismissed.
