Heard learned counsel for the applicant, learned AGA for the State and perused the material placed on record.
The present bail application has been filed by the applicant in case crime No. 180 of 2013 under Section 498A, 304B IPC and Section 3/4 D.P. Act, police station Nehtaur, district Bijnor with the prayer to enlarge him on bail during the pendency of trial.
It is contended by learned counsel for the applicant that the applicant is husband who has been falsely implicated for the death of his wife, who died natural death on account of ailment. It is contended that even the post mortem report would go to show that the cause of death is not known. It is contended that Viscera has been sent for chemical examination which report has not yet come form the chemical analyst. It is contended that although, the applicant is innocent he has been languishing in jail since 03.5.2013 and there is no possibility of the trial to be concluded in near future.
After hearing the learned counsel for the applicant, learned A.G.A. and after perusing the bail rejection order,first information report as well as averments as contained in the present bail application, this Court is of the opinion that the learned counsel for the applicant could not make out any good ground for enlarging the applicant on bail.
Accordingly, the bail application is hereby rejected.
After the order was passed learned counsel for the applicant prayed that the trial of the aforesaid case may be expedited.
Accordingly, court below concerned is directed to conclude the trial of the aforesaid case, expeditiously, strictly in accordance with law, after hearing the parties and without granting unnecessary adjournment to either the parties, preferably within a period of eight months from the date of production of a certified copy of this order before him, provided the proceedings are not stayed by any court of law.
