Heard learned counsel for the applicant and learned A.G.A. for the State and perused the material placed on record.
It is submitted by learned counsel for the applicant that de facto first informant is the father of applicant F.I.R. was lodged for an offence under Section 304-B I.P.C. in the year 2010 and after committal the trial is pending since 2013. All the witnesses of fact and formal witnesses have been examined and the final arguments have started on 14.1.2016. It is stated that for some reasons or other arguments have not been completed till date. The trial is lingering on for past more than six years on account of non-cooperation of the accused Be that as it may, without entering into controversy as to which party is responsible for delaying the arguments, in the fitness of things, this application U/s 482 Cr.P.C. is finally disposed of with a direction to the courts below to conclude the arguments and decide the trial in S.T. No. 126 of 2011 (State vs. Bhopal Saini and others) arising out of Case Crime No.2011 of 2010 under Sections 498-A, 304-B, 323, 506 I.P.C. and 3/4 of Dowry Prohibition Act, Police Station Behat, District Saharanpur in accordance with law without granting unnecessary adjournments to either of the parties as expeditiously as possible preferably within a period of three months from the date of production of a certified copy of this order, if there is no legal impediment.
