The petitioner has preferred this writ petition for a direction upon the District Magistrate, Fatehpur for conversion of the Nazul land to the free hold.
The grievance of the petitioner is that he has moved an application for conversion of 44 sq.mt. of the land which is a portion of Nazul land plot No.555 of Nagar Palika Parishad, Bindaki, District Fatehpur and he has deposited the requisite amount, however, no decision has been taken so far by the District Magistrate.
We have heard learned Counsel for the petitioner and learned Standing Counsel for the State.
With the consent of the parties, the petition is taken on board and is being disposed of in terms of the Rules of the Court.
Only the grievance of the petitioner is that his representation dated 3.8.2018 be decided by respondent no.2, District Magistrate/Collector, Fatehpur.
Considering the facts and circumstances of the case, we are of the view that the ends of justice would be met by issuing a direction upon the respondent no.2, District Magistrate, Fatehpur to consider the application of the petitioner and pass an appropriate order in accordance with law, expeditiously.
The petitioner is granted a liberty to file a fresh representation along with the certified copy within a period of three weeks.
We make it clear that we have not expressed our opinion on the merits of the case and the respondent no.2 shall pass the order independently, in accordance with law.
The petition stands disposed of. There is no order as to costs.
