Heard Sri S.K. Yadav, learned counsel for the petitioners, Ms. Manju Thakur, learned A.G.A. for the State and perused the impugned F.I.R. as well as material brought on record.
This petition has been filed by the petitioner with a prayer to quash the F.I.R. dated 9.2.2018 registered as case crime no. 26 of 2018 under sections 419, 420, 467, 468, 471, 406 I.P.C., police station Rani Ki Sarai, District Azamgarh.
Learned counsel for the petitioners submits that the petitioners have already deposited Rs. two lacs towards the amount in question and he is ready to pay rest of the amount, if some time may be granted to him.
Learned A.G.A. opposed the prayer for quashing.
Considering the facts and circumstances of the case and the submissions advanced by learned counsel for the parties, we direct the petitioners to deposit the rest of the amount in question in two equal installments within a period of three months from today.
For a period of three months from today, the arrest of the petitioners in pursuance of the aforesaid case shall remain stayed.
It is made clear that in case the petitioners fails to deposit the aforesaid amount within the aforesaid period, coercive action shall be taken against them.
With the above direction this petition is finally disposed of.
