Heard learned counsel for the petitioner and learned Standing Counsel for respondents no.1 to 5.
The petitioners are three in number. They have retired from Indian Army on different dates. The petitioner have been appointed as Constable in Uttar Pradesh Police. The petitioners, by means of present writ petition, have prayed for following relief:-
"(a). Issue a writ, order or direction in the nature of mandamus directing the respondent No.3 i.e. D.I.G. P.H.Q. Allahabad/Lucknow to add the service period of Army in the present service as petitioner in the U.P. Police department.
(b) Issue a writ, order or direction in the nature of mandamus directing the respondents to deposit the gratuity of the petitioner in the service of the petitioner."
The grievance of the petitioner is that neither the respondent no.3 has not considered the representations of the petitioners nor has paid any heed to their representations.
Learned counsel for the respondents submits that no useful purpose would be served in keeping the writ petition pending and appropriate direction may be issued to respondent no.3 to consider the grievance of the petitioners.
Considering the facts and circumstances of the case and without going into the merits of the case and with the consent of the parties, the writ petition is disposed of with liberty to the petitioners to file a fresh separate representations before the respondent no.3-Deputy Inspector General of Police, Establishment, UP Police, Lucknow, raising all their grievances within a period of two weeks from today. In case any such representation alongwith certified copy of this order, is filed by the petitioners, the respondent no.3 shall decide the same by reasoned and speaking order within a period of two months thereafter.
The writ petition is disposed of subject to the observations made above.
