Petitioners are before this Court assailing the order dated 12.10.2018 passed by the first respondent in Case No. 00065/2018 (Sunil Kumar Vs. Samar Rastogi and others) under Section 219 U.P.
L.R. Act, 1901 and order dated 9.1.2018 passed by the second respondent in Case No. T- 20150242051503, under Section 34 U.P. L.R. Act.
The petitioners have challenged the proceeding under Section 34 of U.P. L.R. Act. The Court is of the considered opinion that the said proceeding is a summary proceeding and does not confer any right or title over the property in question. In case, the petitioner has any grievance, the appropriate remedy is to file a suit.
The writ petition is dismissed on the ground of alternative remedy.
