Heard Sri Kumar Ashutosh Srivastava, learned counsel for the petitioners, learned AGA for the State and Sri Abhishek Mayank, learned counsel for respondent no. 3 and perused the record.
Respondent No. 3 is personally present before the Court and has produced the corpus Lavi Gurjar, in compliance to order of this Court, who has been duly identified by learned counsel for respondent no. 3.
Upon being enquired, the corpus Lavi Gurjar states that she is aged about 23 years and she is Post Graduate. She further states that her date of birth is 23rd October, 1995. In paragraph No. 6 of the affidavit filed alongwith writ petition, it has been pleaded that the corpus is aged about 22 years. She further states that she does not know petitioner no. 1 Sunil Kumar Koli and she has not performed marriage with him. She further states that she does not want to go with petitioner no. 1. She further states that she is living with her parents and she wants to live with her parents.
In view of above, the corpus Lavi Gurjar is major and she states that she does not know petitioner no. 1 Sunil Kumar Koli, she has not performed marriage with petitioner no. 1, she does not want to go with him and she wants to live with her parents. The petition is devoid of merit and is liable to be dismissed.
Accordingly, the petition is dismissed.
