No one appears to press the present petition. There is a resolution of the High Court Bar Association to abstain from judicial work.
Only prayer made in the present petition that an application dated 30.3.2018 filed by the petitioners with the prayer of vacation of the stay order granted in Original Suit no. 143 of 2017. However, the said application has yet not been decided.
Only prayer made in the present petition is to issue a direction the Court below to decide the pending application dated 30.3.2018 under Order 39 Rule 4 after consideration of the objections filed to it, at the earliest.
In view of the innocuous prayer of the petitioners, without expressing any opinion as to the merits of claim of the petitioners, the present petition is being disposed of with the direction to the Court below to decide the application dated 30.3.2018 for vacation of the stay order granted in Original Suit No. 143 of 2017, preferably, on the next date fixed or on a short date to be fixed within a further period of three weeks, thereafter.
It goes without saying that this Court is not entered into the merits of claim of the parties.
