Sunil Kumar Dixit And Another vs Senior Superintendent Of Police ...

High Court Of Judicature at Allahabad|21 June, 2010

JUDGMENT / ORDER

Hon'ble Vedpal,J.
Connect along with Writ Petition No. 5756 (M/B) of 2010. Heard learned counsel for the petitioners as well as learned Additional Government Advocate, who has accepted notice on behalf of opposite party Nos. 1 & 2.
Issue notice to opposite party No. 3 returnable at an early date. Respective opposite parties may file counter affidavit within six weeks. Rejoinder affidavit, if any, may be filed within next two weeks. List after expiry of aforesaid period.
Since as per argument advanced by learned counsel for the petitioners and as it comes out from the FIR itself the ingredients of the FIR seem to be trivial in nature, we hereby direct that the petitioners shall not be arrested in Case Crime No. 133 of 2010, under Sections 147, 148, 452, 504, 506 IPC read with Section 3 (1) X SC/ST Act, police station Banthara, district Lucknow, provided they cooperate with the investigation which shall go on.
