Heard learned counsel for the petitioner.
This writ petition has been filed seeking the following relief:-
"(i) issue a writ, order or direction in the nature of mandamus directing the District Magistrate, District Rampur to take appropriate action to open the public way from the powerful person in the interest of justice."
It is contended that the public pathway which is used by the petitioner had been blocked by certain powerful persons of the village. The said powerful persons have not been impleaded in the writ petition.
In my considered opinion, the proper remedy available for the petitioner is by means of proceedings under Section 133 Cr.P.C. The petitioner may, in case, so advised invoke the proceedings for redressal of his grievance.
Subject to the above, this writ petition is dismissed.
