Heard learned counsel for petitioners as well as learned AGA for the State.
This writ petition has been filed challenging FIR dated 21.04.2021 registered at FIR/Case Crime No.0219 of 2021, under Sections 323, 506, 147, 148, 149, 332, 333, 353, 395, 188, 269, 171 (ga), 152 I.P.C. and Section 7 Criminal Law Amendment Act, 1932 and Section 3 of Pandemic Act, 1897, Police Station Lalganj, District Pratapgarh.
After arguing the matter at some length, learned counsel for the petitioners states that he may be permitted to withdraw this writ petition with liberty to the petitioner to take recourse to the remedy available under Section 438 Cr.P.C.
Accordingly, the writ petition is disposed of with aforesaid liberty.
However, it is directed that in case the petitioners approach the court of competent jurisdiction by way of moving appropriate application under Section 438 Cr.P.C., the same shall be considered and decided in accordance with law, with expedition.
