Sundarambal Middle School vs The Chief Educational Officer

Madras High Court|22 March, 2017

JUDGMENT / ORDER

This Writ petition has been filed by the petitioner for issuance of a Writ of Mandamus, directing the respondents 1 and 2 to pass orders on the enquiry conducted on 15.07.2016 on the complaint of fourth respondent Nil dated expeditiously.
2. Heard the learned counsel appearing for the petitioner and the learned Special Government Pleader appearing for the respondents.
3. Mr.C.Selvaraj, learned Special Government Pleader, takes notice for the respondents. By consent, the Writ petition itself is taken up for final disposal.
4. The grievance of the petitioner is that the respondents have completed enquiry in relation to the complaint of the fourth respondent. However, they have not concluded by passing final orders on the same. In this regard the petitioner has also issued several notices through his counsel.
5. Now the learned counsel for the petitioner would submit that the petitioner will be satisfied if a direction is issued to the respondents to consider the petitioner's notices on merits in accordance with law within a stipulated time fixed by this Court.
6. However it is brought notice to this Court by the learned counsel for the petitioner that the petitioner has not made any representation and he has only issued legal notices.
7. In such circumstances, the learned Special Government Pleader would request that the petitioner may be directed to file a fresh representation.
8. Having regard to the scope of the prayer in the Writ petition and the submissions made by learned counsel on either side, without expressing any opinion on the merits of the case of the petitioner, this court is inclined to pass the following direction:-
?The petitioner is directed to file a fresh representation within a period of two weeks from the date of receipt of a copy of this order and on such representation, the second respondent is directed to consider the representation and pass appropriate orders on merits and in accordance with law within a period of six weeks thereafter.?
9. Accordingly, the Writ petition is disposed of. No costs.
