Ext.A3 Will has been marked on admission and hence the contents therein can be safely relied on. There is no necessity to prove the Will in the suit when the plaint schedule property is not taken in by Ext.A3 Will. I do not therefore find any justification to interfere with the impugned order passed by the court below.

Original Petition is dismissed subject to the above clarifications.
