Heard learned counsel for the petitioner and learned Standing Counsel for the State-respondents.
The writ petition has been filed seeking the following relief:-
"(I) Issue a writ order or direction in the nature of mandamus commanding and directing to the respondents/authorities/respondent no. 2 (Sub Divisional Magistrate Tehsil - Phoolpur, District - Azamgarh) to decide the restoration application dated 29.11.1999 passed under section 229B of the U.P.Z.A. and L.R. Act by Sub Divisional Magistrate Tehsil - Phoolpur, District - Azamgarh with in some specified period fixed by this Hon'ble Court as the order dated 29.11.1999 has been procured by playing fraud against the petitioner and other family members of a joint family on the basis of forged compromise dated 30.10.1999 after filing of the case under section 229B on 25.9.1999."
The petitioner is aggrieved as his restoration application against a decree in a declaratory suit under Section 229-B of the U.P. Zamindari Abolition and Land Reforms Act is pending consideration since July, 2014.
Under the circumstances, this writ petition is disposed of with a direction to the respondent no. 2/Sub Divisional Magistrate, Tehsil Phoolpur, District Azamgarh to decide the restoration application as expeditiously as possible, preferably within a period of three months from the date a certified copy of this order is filed before him.
