Respondent no.4 Jai Prakash Yadav has produced the corpus Sunita Yadav, who was duly identified by learned counsel Sri Ravi Prakash Pandey.
Upon being asked, the corpus has stated that her date of birth is 30.5.1991 and she is graduate and at present doing course of nurse at Varanasi, by living in hostel. She does not admit her marriage with petitioner no.2 and states that whenever she leaves hostel at Varanasi, she comes back to her father's home at District Mau.
At this stage, learned counsel for the petitioner submits that since the corpus is denying from marriage, the petition for habeas corpus be dismissed as withdrawn and he will seek his remedy before appropriate Court or as advised.
In view of above submission, the present petition is dismissed as not pressed.
The amount deposited, be paid to the petitioner no.1 the corpus.
