Heard Ms. Archana Singh, learned counsel for the petitioner and learned Standing Counsel for the respondents.
The petitioner is before this Court with request to issue direction to the respondent no.2, Chief Medical Officer, Meerut to appoint her on compassionate ground in pursuance of the judgement and decree dated 20.3.2017 passed by the Additional Civil Judge (Senior Division), Court No.2, Meerut in Case No.111 of 2011 (Smt. Sunita vs. Deepak and others), which has not been upset till date and also pay family pension and other terminal benefits of her husband late Pramod Kumar, who was serving as Class-IV employee and died in harness on 7.8.2010.
Learned Standing Counsel states that the respondent no.3 has already forwarded the claim of the petitioner to respondent no.2 and the same is appended as Annexure No.7-A (at page 128 of the paper book) to the writ petition.
No useful purpose would be served in keeping the writ petition pending consideration.
Accordingly, with the consent of parties and without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case, writ petition is disposed of asking the Chief Medical Officer, Meerut to look into the grievance of the petitioner and pass appropriate order strictly in consonance with law expeditiously preferably within a period of two months from the date of production of certified copy of this order.
