This application under Section 482 of Cr.P.C. has been filed by the applicant with the prayer to quash the impugned order dated 28.5.2016 in Criminal Revision no.588 of 2014 by Additional Session Judge Court No.20/ Special Judge (Gangster Act) Agra as well as order dated 30.8.2014 in Criminal Complaint no.369 of 2014, under sections 323, 504, 506 I.P.C., Police Station- Hari Parwat, District- Agra, pending in the court Chief Judicial Magistrate, Agra.
Heard Sri Gaurav Sharma, learned counsel for the applicant and learned A.G.A. for the State. Perused the record.
Learned counsel for the applicant has not been able to point out any such illegality, impropriety or incorrectness, much less than any abuse of court's process which may persuade this Court to interfere in the impugned order. The impugned order reflects judicial application of mind. Basically the matter relates to the discretion of court below and this Court does not find any element of perversity to interfere in the same. The revision also appears to have been filed against order dated 30.8.2014 but the same also did not find favour and was dismissed. The perusal of the revisional court's order also reflects judicial application of mind and this Court does not see any such failure of justice emanating from either of the orders which may persuade this Court to interfere in the same. The prayer for quashing the impugned proceedings cannot be accepted.
The application lacks merits and stands dismissed.
