This petition seeks the quashing of the order dated 5 May 2018 passed by the Regional Manager of the U.P. State Industrial Development Corporation.
It is submitted by learned counsel for the petitioner that no development work was carried out by UPSIDC nor road was constructed and it was also difficult for the petitioner to locate the plot. It is, therefore, his contention that the respondents are not justified in demanding the charges contained in the impugned order.
Sri Prabhakar Awasthi, learned counsel appearing for UPSIDC states that under the new policy, the Managing Director can examine the matter and pass appropriate orders.
This petition is, accordingly, disposed of with a direction to the Managing Director of UPSIDC to pass an appropriate order expeditiously and preferably within a period of two months from the date a certified copy of this order is filed by the petitioner. The order impugned in the writ petition shall abide by the order to be passed by the Managing Director.
It is made clear that till an order is passed by the Managing Director, no steps shall be taken for cancellation of the allotment of the plot of the petitioner.
