This writ petition is filed for declaring the action of the respondents 1 to 7 in not permitting the petitioner to write supplementary examination of first semester Optional German Language of B.A. (Hons.) Programme in English as per the Rules notified in Official Gazette (the Gazette of India) notification of Central Government (Ministry of Law and Justice) dated 11-01- 2007 as illegal, arbitrary and for a consequential direction to respondents 1 to 7 to permit the petitioner to write supplementary exam of first semester Optional German Language of B.A. (Hons.) Programme in English.
2. When the matter is called on for hearing on 21-04-2014, as there was no representation on either side, the matter was directed to be listed on 02-06-2014. Even on 02-06-2014 also, when the matter is called on for hearing, there is no representation for the petitioner. However, the learned standing counsel for the University states that the relief sought for in the writ petition is to permit the petitioner to appear for supplementary exam of first semester Optional German Language of B.A. (Hons.) Programme in English to be held on 21-04-2014 and the said examination is already over and hence, the cause in the writ petition does not survive and has become infructuous.
3. Recording the submission of the learned standing counsel, the writ petition is dismissed as infructuous. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions if any pending shall stand closed.
