Heard Sri R.V. Pandey, learned counsel for the petitioners and learned counsel for respondent nos.1, 3 and 4. Sri Kunal Ravi Singh, has accepted notice on behalf of respondent no.2.
The petitioners' claim that they are owners of the rice mill M/S S.K. Agro Industries' & Nirmala Gramodhyog Sewa Santhan. The respondent no.5 is a rival owner of the rice mill namely Shikha Rice Mill. He has applied under Right to Information Act, 2005 for obtaining certain information regarding the petitioners. When the aforesaid information was not supplied, he preferred an appeal to the Appellate Authority i.e. U.P. State Information Commission.
On the said appeal the Commission has issued notice dated 23.09.2019 to the petitioners.
The petitioners have approached this Court for the quashing of the said notice on the ground that the information sought is of a personal nature and cannot be supplied to the respondent no.5.
Be that as it may, the State Information Commission has only issued notice to the petitioners. The petitioners in response to the said notice may appear before the Commission and take whatever objection they deem appropriate and the same would be considered by the State Commission before passing final order.
The writ petition stands disposed of accordingly.
