An application for enhancement of maintenance under Section 127 Cr.P.C. made by the applicants in proceedings under Section 125 Cr.P.C. where the sum awarded is Rs. 1000/- only to the wife and nothing to the child are pending. By the application under Section 127 Cr.P.C. the applicant has claimed Rs. 10000/- for herself and the child from the husband-opposite party no. 2. The said application is pending. It is submitted that without any reasonable cause, it is lingering on.
Learned counsel has taken this Court through the order sheet which shows that the application was filed on 01.06.2017. A period of more than a year has come to pass and no substantial progress much less a conclusion of the said proceedings is noticeable.
Considering the aforesaid facts and circumstances, the Principal Judge, Family Court Ghazipur is directed to dispose of the application made by the wife under Section 127 Cr.P.C. in Case No. 276 of 2017 'Sunita Devi vs. Jitendra' within a period of three months from the date of receipt of a certified copy of this order unless there be any legal impediment.
With the above orders, this Application stands disposed of.
