As per office report dated 19.01.2019, notice on opposite party No.2 has been served personally. Despite service of notice, no one appears of on behalf of opposite party No.2.
This transfer application has been filed by the learned counsel for the applicant praying for transfer of Sessions Trial No. 307 of 2017, arising out of Case Crime No. 156 of 2017 (State Vs. Ajay Kumar and others), under Section 304-B, 498-A IPC and 3/4 D.P. Act, Police Station Kotwali, DistrictMainpuri, pending in the court of District and Sessions Judge, Mainpuri, to another District.
The ground for transfer of the aforesaid case is that the applicant is the married sister of the deceased and whenever, she goes to Mainpuri, she is threatened by the opposite party No.2, who is accused in the aforesaid case. In the absence of any counter affidavit, the averments made in support of the transfer application are accepted as correct.
This transfer application is allowed. The aforesaid case is transferred from District Mainpuri to District Kannauj.
The District and Sessions Judge, Mainpuri, is directed to forward the record of the aforesaid case to District and Sessions Judge, Kannauj, within the period of two weeks, from the date of production of certified copy of this order for assigning it to the appropriate court.
