Heard learned counsel for the applicant, the learned A.G.A for the State and perused the perused the record.
The present application has been filed by the applicant Smt. Sunita Devi challenging the order dated 14.05.2019 passed by the Chief Judicial Magistrate, Aligarh in Case Crime No. 15 of 2019 under section 420,467,471 I.P.C., Section 15(2) Indian Medical Counselings Act 1956 and Section 30 of Combined State Medical Act, 1917, Police Station Barla, District Aligarh whereby the application of the applicant has been rejected.
Learned counsel for the applicant raised certain objections which were considered by Chief Judicial Magistrate, Aligarh while passing the said order dated 14.05.2019.
Having heard learned counsel for the parties and perused the record, order dated 14.05.2019 is hereby set aside and the matter is remanded back to the Chief Judicial Magistrate, Aligarh to pass fresh order after inviting objection from the applicant concerned.
With the above observation/ direction, the application stands disposed of finally.
