By means of present writ petition, petitioners have sought following reliefs:
1. Issue a writ order or direction in the nature of mandamus commanding and directing the police authorities of district and Police Station concerned to stop the illegal construction being made by the respondents no.
5 to 9 at the land Arazi no. 480 area 15 Dismil with immediate effect in compliance of orders dated 22.3.2012, 5.4.2012 and 30.7.2012 passed by Settlement Officer Consolidation and Sub-Divisional Magistrate, Tehsil Shahganj to be protected the existence of the Primary Pathshala since the case pending in the court of Settlement Officer Consolidation, Jaunpur is decided between the parties regard to forged entries at the Primary Pathshala Land.
2. Issue a writ order or direction in the nature of mandamus commanding and directing to the respondents/ authorities to maintain the status quo on spot, regard to the nature of Land Arazi no. 480 which was earlier Gata no.
338 as the same was reserved land for the Primary Pathshala and illegally and fraudulently got the name recoded in the revenue records i.e. Khatauni at the instance of Lautan, who was the then Pradhan of the concerned Village and at the instance of that entries the construction is being made, even several orders have been passed by the authorities.
Since matter is pending before Deputy Director of Consolidation who has passed an order on 13.3.2014 directing the parties to maintain status quo in respect of property in dispute, we do not see any justification to interfere in the matter.
With the aforesaid observations, writ petition stands dismissed.
