JUDGMENT / ORDER

1. Petitioner has approached this Court complaining about the inaction on the part of the competent authority among the respondents in not considering Exts.P9, P10 and P13 representations. Petitioner submits that it is running a saw mill and has obtained necessary licence from the Inspector of Factories and Boilers. Petitioner has obtained No Objection Certificate from the Divisional Forest Officer, Palakkad which is renewed upto 31.3.2011. Ext.P6 is the NOC issued by the D.F.O., Palakkad on 22.4.2010. When the petitioner submitted Ext.P9 representation for establishing an electric motor, having an enhanced capacity of 34.9 HP, the same has not been W.P.(C)No.8887 of 2014 -:2:-
considered by the respondent authority so far, is the complaint of the petitioner.
2. Learned Government Pleader, on instructions, would submit that the petitioner has not submitted the application in the proper form prescribed under the Kerala Forests (Regulation of Saw Mills and other Wood Based Industries) Rules, 2012. Apparently, after framing of the Rules, the petitioner has to submit application based on the format provided in the Rules, which has not been done so far.
3. In the facts and circumstances stated above, I am of the view that this writ petition can be disposed of as under:
Petitioner is at liberty to submit a fresh application as per the format provided in the Rules for increasing the capacity of HP motor with prescribed W.P.(C)No.8887 of 2014 -:3:-
fee and on receipt of the same, the respondent authority is directed to consider the same and pass appropriate orders, within one month from the date of receipt of copy of the application.
Writ petition is disposed of accordingly.
