JUDGMENT / ORDER

Heard learned advocate Ms. Amee Yajnik for the appellant. The appellant – Insurance Company challenges judgment and award rendered by Motor Accident Claims Tribunal, Sabarkantha at Himatnagar, in Motor Accident Claim Petition No.489 of 1997, where the Tribunal awarded compensation of Rs.94,000/- from the appellant, with costs and interest against the claim of Rs.1,50,000/-, on account of injuries to the minor claimant. 2. The claim petition was preferred under Section 163A of the Motor Vehicles Act.
2.1 The appellant does not dispute the involvement of the vehicle or its liability. It is not the case of the appellant, that the Tribunal has committed any error in computing the quantum of compensation as per schedule contemplated under Section 163A of the Motor Vehicles Act. If the award is as per the schedule under Section 163A of the Motor Vehicles Act, there is no scope for interference by the appellate Court. The appeal must fail and stands dismissed with no order as to costs.
